There are complex limitations questions, and homicide offenses are different. But we are not prosecutors."

"I don't even know whether this was homicide."

"No."

"Do you believe Lisa?"

He looked at her.

"I believe she is describing something investigators need to test."

That was enough.

Police interviewed Lisa for nearly six hours.

Her attorney arrived halfway through.

She surrendered old email accounts.

She identified the warehouse.

The building still existed, though Michael had sold his business years earlier.

Records showed he leased one storage unit there under Hale Family Holdings until nine years ago.

Investigators obtained archived access data.

Most physical records were long gone.

But a former warehouse employee remembered a late-night fire in a steel disposal barrel behind the building around the week Richard died.

Nobody reported it because employees sometimes burned packaging waste.

Jennifer and Evelyn had been seen there.

The employee remembered because both women were dressed too formally for the warehouse.

Police located him in Arizona.

He agreed to give a statement.

The next discovery came from Evelyn's drive.

One audio file was labeled R.H. Final.

The detective called me to the station.

This time, he allowed Thomas and me to hear the entire recording.

He warned me first.

"It may be extremely difficult."

"I've already lived through the ending."

"Not like this."

I looked at him.

"Play it."

The file began at 7:41 a.m. on the day Richard died.

Office sounds.

A drawer.

Footsteps.

Then Richard.

"You're early."

Evelyn answered.

"You said seven-thirty."

"Sit."

A pause.

Richard accused her of helping Michael access title records and beneficiary documents.

Evelyn denied knowingly participating in forgery.

She admitted she had made "exceptions" for Jennifer.

Richard told her exceptions were another word for fraud.

Evelyn said Michael was desperate and Richard was destroying his son's future.

Richard replied, "Michael is destroying his future."

Again, the language we had repeated thirteen years later.

Then a door opened.

Michael entered.

Richard said, "I didn't invite you."

Evelyn whispered, "Michael."

He answered, "We need to end this."

Richard told him to leave.

Michael refused.

They argued for several minutes about the bank.

Richard said he had an appointment with Thomas that morning.

Michael insisted they settle the issue privately.

Then came the sound of a cup being moved.

Richard noticed.

"What did you put in that?"

Michael answered, "Nothing."

"Don't lie to me."

A chair scraped.

Evelyn said, "It's just something to lower your anxiety."

I stopped breathing.

Richard swore at her.

"What did you give him?"

Michael replied, "His medication."

"Which one?"

No answer.

Richard said, "Call an ambulance."

Evelyn answered, "You don't need one."

"Call."

His breathing had changed.

Heavy.

Uneven.

Michael said, "Dad, sit down."

"Don't touch me."

A crash.

I covered my mouth.

On the recording, Richard struggled for breath.

Then he said something so faint the detective replayed it.

"Maggie."

My name.

The last word my husband may have spoken.

I bent forward.

Thomas placed his hand on my shoulder.

This time, I did not refuse it.

The recording became frantic.

Evelyn told Michael to call emergency services.

Michael said they needed to remove the papers first.

Evelyn screamed at him.

"Call now!"

He said, "If they see this—"

"Your father is dying!"

Then the emergency call began.

Later records showed the official 911 call was placed at 8:03.

The recording timestamp suggested Richard began experiencing distress around 7:52.

Eleven minutes.

They waited approximately eleven minutes.

The detective paused the file.

I stared at him.

"Could those minutes have mattered?"

"Possibly."

Not certainly.

Possibly.

That word would stay with me forever.

The file resumed.

Sirens eventually approached.

Michael could be heard saying, "The cup."

Evelyn answered, "What?"

"Take it."

Then nothing more.

The recording ended.

I sat without speaking.

Thomas finally asked why Evelyn had kept such devastating evidence.

The detective said blackmail was the likely answer.

Evelyn recorded people.

Saved documents.

Kept evidence of crimes in which she herself participated.

Insurance.

If Michael ever turned on her, she could destroy him.

If Jennifer blamed her, she had proof.

If anyone refused payment, she held leverage.

Fourteen years of mutually assured destruction.

Richard had walked into the middle of it.

Then I had.

The prosecutor requested a formal meeting.

He explained the difference between what we knew morally and what could be proved legally.

Michael's administration of medication to Richard might support serious charges.

The delay in calling 911 mattered.

The destruction of evidence mattered.

But Richard's cause of death could not now be scientifically tied to the drug.

Without toxicology, proving murder beyond a reasonable doubt would be difficult.

Other charges were more straightforward.

Forgery.

Fraud.

Evidence destruction.

Conspiracy.

Potential reckless endangerment.

And regarding me, there was much more recent evidence.

The remaining hospital blood sample.

Jennifer's dosage notes.

The hidden medication.

The recording.

The false power of attorney.

The house-transfer attempt.

The burglary.

The incapacity scheme.

There would be consequences.

Perhaps not the exact ones grief demanded.

But consequences.

I met Michael once.

Only once.

His attorney arranged the meeting after he learned investigators had the R.H. Final recording.

Michael entered wearing county-issued clothing.

He looked at me without anger.

For the first time in my life, my son looked frightened of me.

"Mom."

"Did you know Dad called my name?"

His eyes filled.

"I heard."

"You waited."

"I panicked."

"For eleven minutes."

"I thought he'd recover."

"Because he'd recovered the first time?"

Michael looked down.

So Jennifer had told the truth.

There had been an earlier dose.

"Why did you do it again?"

"I needed him calm."

"You needed his signature."

"Yes."

"Did you mean to kill him?"

"No."

He started crying.

"No. God, no."

I believed that part.

And discovered belief did not equal forgiveness.

"Did you know the drug could hurt his heart?"

"Evelyn said it was safe."

"What did you give him?"

"Extra beta blocker and something for anxiety."

"Whose anxiety medication?"

"Evelyn's."

My stomach turned.

"Then thirteen years later you helped her do essentially the same thing to me."

"I didn't know about the first dose."

"The Christmas dose?"

"I knew."

"That was enough."

He wiped his face.

"Jennifer said it would just make you sleepy."

"You believed that after Dad?"

He had no answer.

"How could you?"

"I was desperate."

"So was Richard when he died."

Michael looked at me.

I continued.

"So was I in the hospital."

He dropped his gaze.

"I don't expect you to forgive me."

"Good."

The word surprised us both.

All my life, I had been the mother who offered forgiveness before anyone finished apologizing.

Not anymore.

He whispered, "What happens now?"

I thought about his old demand.

Figure things out yourself.

So I gave him the answer he had given me.

"You have a lawyer."

He flinched.

"Let the system figure it out."

I stood.

"Mom."

I stopped at the door.

"I do love you, Michael."

He began crying again.

"But love is not the same thing as rescue."

Richard's words.

My lesson.

I left.

Two weeks later, Thomas called me to his office.

The criminal cases were still unfolding, but he had received an unexpected communication.

A private lender had filed a claim against Jennifer's expected inheritance.

Because my current trust left her no direct inheritance, the claim was essentially worthless.

But attached to the lender's documents was something else.

A financial disclosure Jennifer signed months before my hospital admission.

She listed expected assets she believed she would receive from me.

Cash.

Investments.

A third of my home.

Personal property.

Jewelry.

Then one line at the bottom.

Projected inheritance from mother's estate: $1,865,000.

I stared at the number.

"That is more than my entire estate."

Thomas nodded.

"Exactly."

"Where did she get it?"

"We don't know."

Then he placed another document beside it.

An appraisal.

My house.

My investments.

Richard's old insurance policies.

And an asset I did not recognize.

Mountain property.

Estimated value: $620,000.

I looked at Thomas.

"What mountain property?"

He turned the page.

A parcel outside Breckenridge.

Forty acres.

Titled not to me.

Not to Michael.

Not to Hale Family Holdings.

To the Richard Hale Family Trust.

Created twenty-two years ago.

I had never heard of it.

Thomas hadn't either.

The trustee listed on the original filing was Richard.

The successor trustee was blank.

But a handwritten amendment had been recorded after his death.

It named Jennifer.

My daughter had quietly controlled property worth more than half a million dollars for thirteen years.

Property that, according to the trust language, was supposed to pass to me.

Click here to continue reading: PART 9: The Mountain Property Jennifer Hid for Thirteen Years Contained a Small
