Do you know whose phone it is?"

Maya nodded.

"Daddy's."

Julian's lawyer stood.

"Your Honor, I think we should be careful about allowing a child to introduce an electronic device without understanding its contents or origin."

"I agree that we should be careful," Judge Thorne replied. "That is why I'm asking questions."

The lawyer sat down.

Maya rubbed her thumb over the scratch on the case.

I recognized the movement.

She did the same thing with her rabbit when she was nervous.

"How did you come to have your father's phone?" the judge asked.

Maya hesitated.

"I found it."

"Where?"

She looked toward the floor.

"At home."

I wanted to help her.

But I knew I couldn't answer for her.

Judge Thorne waited without rushing her.

Maya finally lifted her face.

"I saw something on it, and I didn't know if it was bad."

Julian's chair creaked.

"She's six," he said. "She doesn't understand what she's talking about."

Judge Thorne turned toward him.

"Mr. Vance, your daughter is trying to answer my questions. Please let her do so."

He pressed his lips together.

Maya's fingers tightened around the phone.

I could see her struggling to decide how much to say.

Then she looked at me.

"I'm sorry, Mommy."

Those two words nearly broke me.

I leaned forward.

"You haven't done anything wrong, sweetheart."

She stared at me for another second.

Then she turned back toward the judge.

"I wanted to tell you before."

"Before what?" the judge asked.

"Before Daddy takes me away."

I forgot how to breathe.

The courtroom became very still.

Julian looked down at the table.

Evelyn reached for his shoulder, then seemed to think better of it.

Chloe's hand dropped into her lap.

I had spent weeks trying to understand why Maya seemed frightened whenever we discussed the future.

I had blamed the tension in our home.

I had blamed myself for not finding better words to reassure her.

Now I was hearing that she believed her father might take her away before she could tell someone what she knew.

Judge Thorne's expression softened, but her voice remained steady.

"Maya, nobody is going to ask you to make a decision about which parent you love. Do you understand that?"

Maya nodded.

"Good. I want you to know that you can tell me what happened, and the adults will be responsible for deciding what it means."

My daughter looked at the phone.

Then she asked the question I had not expected.

"Can I show you the video?"

The judge glanced toward the child advocate.

The advocate looked at the device and then at Maya.

"Do you know how to find it?"

Maya nodded.

"I watched it before."

I stared at her.

She had watched it before.

Alone.

I wondered how many times she had replayed whatever was on that screen.

I wondered whether she had understood it.

I wondered whether it had frightened her.

And I wondered how long she had been trying to decide whether showing it to someone would make things worse.

Judge Thorne looked toward the courtroom clerk.

"Let's see whether we can review the material appropriately."

The clerk approached the table.

Maya held the phone out, but when the clerk reached for it, she pulled it back.

"Please don't delete it."

The clerk paused.

"No one is going to delete anything, Maya."

She studied the clerk's face.

Then she slowly handed over the phone.

I watched the clerk examine the device.

The phone was locked, but Maya explained how to open it.

She pointed to the screen and told the clerk which icon to press.

The simplicity of the gesture made my chest ache.

She had practiced.

My six-year-old daughter had practiced showing someone a video because she was afraid she might lose the chance to tell the truth.

The clerk connected the device to the courtroom display system.

The screen at the front of the room remained dark.

Judge Thorne asked everyone to remain quiet while the material was prepared.

Julian leaned toward his lawyer.

I couldn't hear what he said.

His lawyer whispered something back.

Julian shook his head.

For the first time since I had entered the courthouse, he looked less like a man certain of the outcome and more like someone trying to calculate the damage from a decision he could no longer control.

I wanted to know what was on that phone.

I also dreaded finding out.

Maya sat with the advocate's hand resting lightly on the back of her chair.

She looked at me one more time.

I gave her a small nod.

Not because I understood.

Because I wanted her to know I was still there.

The clerk finished preparing the display.

Judge Thorne looked at Maya.

"Are you ready?"

Maya took a breath.

"Yes, Your Honor."

The clerk pressed play.

Click here to continue reading: PART 6: When the Video Appeared on the Courtroom Screen, I Recognized My Husband’s Voice Before I Understood What My Daughter Had Seen

For a moment, nobody moved.
