2 – My Mother Tried to Dismiss Nana’s Last Decision, but the Lawyer Had One Important Detail She Had Not Expected

My mother’s next argument was about Nana herself.

Not the document.

Not the witnesses.

Not the instructions that had been changed.

Nana.

She claimed my grandmother had been too ill to understand what she was signing.

I remember how quickly the accusation came.

There was no hesitation.

No quiet question about her condition.

My mother spoke as though the matter had already been settled.

Nana had been dying.

Therefore, according to my mother, the amendment could not be trusted.

I understood one part of what she was saying.

Nana had signed the document near the end of her life.

Three days before her death was not a detail anyone could ignore.

But I also understood that being close to death did not automatically mean someone had lost the ability to make decisions.

Those were two different things.

My mother was treating them as though they were the same.

Mr. Caldwell did not.

He allowed her to make her objection.

Then he answered it.

He explained that Nana’s doctor had assessed her ability to make decisions.

The doctor had provided written confirmation.

Nana had been mentally capable when she signed.

That was the answer.

Quiet.

Direct.

And very difficult to dismiss with another angry interruption.

I looked at my mother.

She had been so certain.

A moment earlier, she had acted as though Nana’s final illness was enough to invalidate the amendment.

Now Mr. Caldwell was telling her that the question had already been addressed.

Not by a family member.

Not by someone trying to defend an inheritance.

By Nana’s attending physician.

And not merely through a conversation that someone remembered differently afterward.

There was written confirmation.

That mattered to me.

I kept coming back to the same thought.

Nana’s condition had not been ignored.

Someone had considered it when the amendment was made.

Someone had put that assessment in writing.

The lawyer had just explained that the document was witnessed and notarized.

Now he was telling us that there was medical confirmation of Nana’s competence.

Each answer made the amendment harder to dismiss.

My mother had challenged its existence.

He had given her the date.

She had challenged how it was signed.

He had explained the witnesses and notarization.

She had challenged Nana’s state of mind.

He had answered that too.

I was beginning to understand that Mr. Caldwell had not come to the reading with an unsupported last-minute claim.

He was referring to a formal document.

A document that carried Nana’s signature.

I still did not know what it said about the estate.

That was the part I wanted to hear.

And it bothered me that we had not reached it.

My mother was arguing about whether Nana could make the decision.

I was waiting to learn what decision she had made.

I thought that was a reasonable thing to want.

It was her will.

Her estate.

Her amendment.

Nobody had yet given us a reason to believe those instructions were anything other than her own.

My mother’s certainty started to trouble me.

Not because I had discovered some secret.

I had not.

And not because Mr. Caldwell’s explanation told me who was right about every possible legal question.

It did not.

What troubled me was the way my mother seemed to need Nana’s last decision to be meaningless.

She had heard that the amendment was signed.

She had heard about the witnesses.

She had heard about the notary.

And now she had heard about the doctor.

Yet none of those facts appeared to be what she wanted.

She wanted the amendment rejected.

I could see that much.

I could not see why.

For a moment, I caught myself thinking about what I would have done if the situation were reversed.

What if I had been disappointed by Nana’s final instructions?

What if those instructions left me with less than I expected?

Would I have questioned her ability to understand what she was doing?

I wanted to believe I would not.

But looking back at myself, I could not claim to know exactly how I would react to words I had not yet heard.

I could only judge what was happening in front of me.

And what was happening did not feel right.

My mother was speaking for Nana.

Mr. Caldwell was presenting what Nana had signed.

Those were not the same thing.

There was another detail I could not ignore.

My father.

While my mother challenged the amendment, he had not joined her argument.

At first, I thought perhaps he was allowing her to speak for both of them.

Then I looked at his face again.

It was not the face of someone merely waiting for his turn.

I had seen him angry before.

I knew what his anger looked like.

This was different.

He looked afraid.

I kept watching him, trying to decide whether I had misunderstood.

He did not need to say anything for me to notice the change.

It was there.

And it frightened me more than my mother’s shouting.

Anger could mean disappointment.

Anger could mean frustration.

Anger could mean someone believed they had been treated unfairly.

But fear suggested something else.

I did not know what it suggested yet.

I only knew that my father appeared to be reacting to more than the possibility of an altered inheritance.

I looked from him to my mother.

Then to Mr. Caldwell.

The lawyer had answered the questions about the amendment’s execution and Nana’s mental condition.

There was no reason for us to remain stuck on whether she had signed it.

I wanted him to move forward.

I wanted the words Nana had left behind to be heard.

For the first time during the reading, my mother’s objections no longer felt like something I should simply sit through.

I was beginning to feel that allowing her to control the conversation might mean never learning what Nana had actually decided.

And that was something I was no longer willing to accept.
