She had already explained that she could not disclose confidential counseling records without appropriate authorization, and she maintained that boundary. This time, however, she offered to review the limited administrative notes she was legally able to discuss and to ask her practice’s records officer whether any additional documentation could be released with Elena’s consent.

Elena signed the necessary authorization that morning. She did not ask me to sign anything, and I did not offer to speak on her behalf. It was her counseling history, her medical information, and her decision about which parts of it she wanted to bring into the investigation.

We met Rebecca in a small conference room at her practice. She greeted Elena warmly but did not pretend that their former professional relationship made the conversation easy. She explained that her notes were not a medical record of the clinic’s work and could not establish what Dr. Vale had decided. They could, however, help us understand what Elena had reported at the time and what the clinic might have been asking about.

“I want to be very clear,” Rebecca said. “I remember being concerned that Elena had not received a satisfactory answer. I do not remember anyone telling me the disputed result had been confirmed, and I had no authority to decide anything about her treatment.”

Elena folded her hands on the table. “What did they ask you?”

Rebecca opened a copy of the releasable notes. The entry from the relevant date recorded a call from someone identifying themselves as a representative of Vale Clinic’s director’s office. The caller asked whether Elena had received written communication about an administrative review.

“That is what you told us before,” I said.

“Yes,” Rebecca replied. “But the next line may matter. I wrote that I told the caller Elena had not shown me a letter and had expressed frustration about not receiving written confirmation of the sample discrepancy.”

Elena stared at the page. “I told you that because I thought I was supposed to request a letter.”

“I remember,” Rebecca said. “You were trying to establish whether the report had been corrected. You believed the clinic had information you had not been given. I encouraged you to ask for the information directly and in writing because I did not want you relying on my interpretation of a medical matter.”

“What did the caller say after that?” Elena asked.

Rebecca turned to the following line. Her notes said the caller thanked her and asked whether Elena intended to pursue another appointment. Rebecca had answered that Elena was considering further testing but wanted to understand the existing records first. The caller then said the clinic would review the matter internally.

“That’s all I recorded,” Rebecca said. “I did not write that they asked me to persuade you not to pursue testing. I did not write that they asked me to keep information from you. I cannot say those things happened.”

“Did you tell them about my doubts?” Elena asked.

“Only what you had already told me about your concerns, and only in response to their questions. I was careful not to disclose details from our sessions. I believed I was confirming whether you had received a letter, not discussing your private counseling.”

Elena looked down. I could tell she was weighing her disappointment against the need to be fair. She had once suspected that someone had used her counseling relationship to interfere with her treatment. The notes did not support that conclusion. They suggested something more ordinary, and in some ways more disturbing: a clinic trying to determine whether a patient had been informed of a problem, while the records showed that the patient had not received a formal explanation.

“Why would they call you instead of calling me?” I asked.

Rebecca did not pretend to know. “That is a question for the clinic. The note in the medical file says not to contact Elena directly until Dr. Vale had spoken with a family representative. I cannot tell you who wrote that instruction or why it was there. I can only tell you what I remember from my end.”

The phrase “family representative” had troubled us since it first appeared. It sounded as though someone had decided that information about Elena’s health should pass through another person. Yet the record did not identify that person, and Rebecca had no evidence that she had been appointed as one. She had not been asked to act as Elena’s representative, and she had not agreed to do so.

Elena asked whether the caller had mentioned me.

Rebecca studied the note. “I recorded no name. There is no reference to your husband in the entry.”

“So they might have meant Daniel,” Elena said, “but we don’t know.”

“Correct.”

I felt a familiar impulse to defend myself before anyone had accused me. I had never been formally appointed as Elena’s medical representative, and I had not authorized the clinic to communicate through me. But I had accompanied her to some appointments, spoken with doctors when she was too upset to continue, and often answered questions first because I thought I was helping.

“Did I ever tell you the clinic had spoken to me privately?” I asked Elena.

She considered it. “You said Dr. Vale had been reassuring. I don’t remember you saying there had been a private call about the discrepancy.”

“I don’t remember one either.”

Rebecca closed the folder. “I think you should keep two questions separate. One is whether the clinic had a valid reason to delay direct communication. The other is whether your relationship made it easier for both of you to accept a delay without insisting on a written answer.”

Neither Elena nor I responded immediately. Rebecca had not accused us of anything. She had simply pointed out how an administrative failure could intersect with the habits we had developed in our marriage.

Before we left, Rebecca gave Elena a copy of the releasable note and the practice’s confirmation that the call had been logged. She explained that no further details were available in her office’s records. The note was signed and dated according to the practice’s procedures, but it could not verify what the clinic had recorded on its side.

Outside, Elena stood on the pavement for a moment, holding the folder against her chest.

“I thought there would be a sentence in there that explained everything,” she said. “Something that proved someone had decided I shouldn’t know.”

“I thought so too.”

“Instead, there’s a record of someone asking whether I got a letter. And I didn’t.”

“That still matters.”

“Yes. It matters. But it doesn’t give me the person I can point to and say, ‘You did this.’”

I understood why she wanted that person. Anger could provide a direction for pain, and a named decision-maker could make the years of confusion feel less shapeless. But the evidence was not ready to give us that answer.

Paul reviewed Rebecca’s note later that day. He observed that the clinic’s outgoing call index and the counselor’s record supported each other on the fact and general purpose of the contact. They did not establish the caller’s identity, the precise wording of the conversation, or whether the clinic took any action afterward because of Rebecca’s response.

He also pointed out that the call occurred on the same day as the amended report and the handwritten note instructing staff not to contact Elena until Dr. Vale had spoken with a family representative. That timing made the call relevant, but it did not prove the two entries had been created by the same person or as part of a single decision.

“What if they were trying to contact me through Rebecca?” Elena asked during our evening call.

“They may have been checking whether you received the draft,” I said. “Or they may have been trying to find out whether you planned to request another appointment. We need more evidence.”

“And what if the person they meant by family representative was you?”

I did not answer immediately. I had spent years assuming that my role as her husband entitled me to help manage the difficult parts of her medical life. I had not thought of that as control. I had thought of it as support. But if the clinic had decided to speak to me instead of her, and if I had accepted that arrangement without insisting she receive the same information, then my good intentions would not have made the consequences harmless.

“I never asked them to keep anything from you,” I said. “But I might have made it easier for them to treat me as the person who could handle it.”

Elena watched me through the screen. “That’s possible. I don’t want to turn it into a fact without evidence, either.”

We agreed that Paul should ask the records custodian for any document defining the clinic’s use of the phrase “family representative,” along with any authorization forms or contact-preference forms associated with Elena’s case. If a form existed, it might show whether Elena had ever consented to communication through me. If no form existed, that absence would still need to be interpreted cautiously, because records could be incomplete.

Two days later, the custodian responded. The transferred archive contained a general consent form signed by Elena when she first registered at Vale Clinic. It allowed the clinic to share information with a named contact only if that contact had been entered on a separate authorization page. The separate page was referenced in the index but was missing from the file.

Elena’s name appeared beside a checkbox indicating that the authorization section had been reviewed. There was no visible name in the field for an approved representative, and no signature from me.

The custodian could not tell whether the page had never been completed, had been separated during filing, or had been lost before the records were transferred. The form did not prove that the clinic had permission to speak to me about the disputed result. It also did not prove that the clinic had actually done so.

Elena read the custodian’s message, then closed her laptop.

“I’m tired,” she said. “Not just of this investigation. I’m tired of finding another missing piece every time we think we’re close.”

“You can take a break.”

“I know. But I don’t want the clinic’s missing records to become another reason I stop asking questions.”

“Then we’ll keep asking. At your pace.”

She studied me for a moment, perhaps looking for the urgency that had once made every conversation feel like a demand. When she did not find it, she nodded.

The following morning, Paul informed us that the custodian had located a staff-routing register from the same period. It listed the initials M.S. beside a transfer from the medical review queue to the director’s office, followed by a notation that the case was awaiting “authorization for patient communication.”

Martin Shaw’s initials had appeared before on the fax cover sheet. But the register did not yet establish that he had entered the note, and it did not explain what authorization was required.

Click here to continue reading: PART 16: Martin Shaw Identified the Missing Authorization, but His Answer Exposed a Decision No One Had Documented

Rebecca Coleman agreed to speak with us again after Paul sent her the newly discovered call index.
