32 – The Appeal Tested the Case One More Time, but the Strongest Part of Emily’s Future Was That She No Longer Needed the Verdict Every Day

The appeal began as expected.

Thomas’s attorneys challenged several rulings.

Admission of portions of Laura’s recordings.

Limits on cross-examination.

The lamp evidence.

Parts of Emily’s testimony.

The sufficiency of evidence supporting intent rather than accidental death.

Sarah learned about the filings through the prosecutor’s office.

She was not surprised.

Jennifer was.

“I thought the jury decided.”

“They did.”

“Then how can he keep doing this?”

“Appeals review whether legal errors affected the trial.”

Jennifer rubbed her forehead.

“Does Emily need to testify again?”

“Usually not for the appeal itself.”

That was the only answer she cared about immediately.

“No courtroom?”

“Not for her right now.”

Jennifer exhaled.

She told Emily only what was necessary.

“Your dad’s lawyers asked another court to review the trial.”

“Can they make him not guilty?”

“There are different possible outcomes.”

Emily frowned.

“Do I have to go?”

“No.”

“Okay.”

Then she returned to building a school project about plant growth.

Jennifer watched her glue labels onto paper cups.

Months earlier, news about Thomas could derail an entire day.

Now it occupied less space.

Not none.

Less.

The appellate process moved slowly.

Written briefs.

Responses.

Records.

Arguments about law.

Thomas’s attorneys emphasized that no witness saw him strike Laura and that the prosecution’s proof of intent was circumstantial.

The state responded that circumstantial evidence carried the same potential legal weight as direct evidence when properly evaluated and that the jury had been entitled to consider the full sequence.

Pre-death threats.

Laura’s immediate plan to leave with Emily.

Thomas’s knowledge of that plan.

The timing of the lamp event.

The fatal injury.

Failure to seek help.

Cleanup.

Concealment.

Repeated deception.

Manipulation of witnesses.

Physical evidence linking the weapon fragments to Thomas’s property and Laura’s grave.

The appeal also attacked Emily’s supplemental interview.

The record mattered here.

Lena’s procedures had been documented.

Emily had not been informed of the Pine Ridge discoveries before describing Michael, the blue bag, Thomas pointing, and Laura’s car.

That chronology protected the evidence from the strongest contamination argument.

Sarah read the appellate brief only once.

She did not spend days rehearsing rebuttals.

The trial record already existed.

Her job had been to create it carefully.

Now lawyers would argue from it.

Daniel had moved temporarily to a different assignment.

Claire continued dispatching.

María trained new officers on child-welfare calls and used anonymized scenarios based on lessons from the case without exposing protected details.

The system moved on.

Not because Laura mattered less.

Because institutions could not stop at one tragedy.

Jennifer found that difficult at first.

She expected the world to remember Laura every morning.

But grief existed privately even when courtrooms emptied.

Laura’s birthday came in spring.

Jennifer planned nothing large.

Emily asked whether they could make a cake.

“What kind?”

“Lemon.”

Jennifer laughed.

“Your mom hated lemon cake.”

Emily looked surprised.

“She did?”

“She said desserts shouldn’t taste like cleaning products.”

Emily laughed.

“What did she like?”

“Chocolate.”

“So chocolate.”

They made one.

It sank in the middle.

Emily stared at it.

“Bad.”

“Your mom would’ve eaten it anyway.”

“How do you know?”

“She ate everything chocolate.”

They covered the center with frosting.

After dinner, Emily put one candle in the cake.

Not because Laura’s age was one.

Because one was enough.

They lit it.

Emily asked, “Do we sing?”

Jennifer considered.

“If you want.”

Emily shook her head.

Instead they each told one memory.

Jennifer told the sandwich story.

Triangles.

Never squares.

Emily told the ugly-lamp story.

Then she added something new.

“Mommy used to scratch my back when I couldn’t sleep.”

Jennifer had not known that.

Emily smiled.

“She did tiny circles.”

The memory had no courtroom value.

No evidentiary significance.

No timestamp.

That made it precious.

Laura was becoming more than the woman in a murder trial.

She was slowly returning to Emily as a mother.

The appellate ruling arrived months later.

The conviction was affirmed on the principal challenged grounds.

Some legal arguments were rejected directly.

Others were deemed insufficient to disturb the verdict.

Thomas retained additional avenues for review.

The prosecutor called Jennifer.

She listened.

“Does anything change for Emily?”

“No.”

“Does he come home?”

“No.”

Jennifer closed her eyes.

“Okay.”

She thanked him.

Then she did not immediately tell Emily.

Not because she planned to hide it.

Because Emily was at Lily’s birthday party.

There was no reason to interrupt cake and balloons with appellate law.

That decision itself showed how much Jennifer had changed.

At first, every legal event felt like something Emily needed to know immediately.

Now Jennifer understood that childhood should not orbit the court system.

When Emily came home, she carried a party favor bag and wore a paper crown.

Jennifer waited until after dinner.

“The court reviewing your dad’s case made a decision.”

Emily looked up.

“What?”

“They left the conviction in place.”

Emily absorbed that.

“So nothing changes?”

“Nothing changes right now.”

“Okay.”

She opened the party favor bag.

“There’s slime.”

Jennifer stared at her.

“Slime?”

“Purple.”

The legal update ended there.

Later that evening, Jennifer called Sarah.

“She barely reacted.”

Sarah said, “That’s probably not a bad thing.”

“I thought she’d care more.”

“She may care plenty.”

Jennifer leaned against the kitchen counter.

“Then why not show it?”

“Maybe because the verdict isn’t holding her whole life together anymore.”

Jennifer became quiet.

Sarah continued.

“She knows where she lives. She knows who picks her up. She knows the door is hers. The appeal didn’t change those things.”

Jennifer looked toward the staircase.

“Yeah.”

“She may still have difficult days.”

“I know.”

“Anniversaries. Questions. Anger.”

“I know.”

“But legal certainty and emotional recovery aren’t the same timeline.”

Jennifer smiled faintly.

“You sound like Naomi.”

“I’ll take that as a compliment.”

They ended the call.

Upstairs, Emily was stretching purple slime across her desk.

It stuck to one of her worksheets.

She groaned.

For ten minutes, the biggest problem in her world was separating slime from paper.

Jennifer helped.

Neither mentioned Thomas again that night.

A week later, Emily’s class had an assignment.

Write about a person who helped you.

Emily considered Claire.

María.

Jennifer.

Naomi.

Laura.

She chose Laura.

Mr. Lawson read the first sentence over her shoulder.

My mom helped me even when she could not finish helping me.

He stopped.

“You want help with the assignment?”

Emily shook her head.

“I know what I want to say.”

She wrote about the trip Laura had planned.

The red sweater.

Jennifer’s house.

The fact that Laura wanted her safe.

She did not write how Laura died.

She did not write about Pine Ridge.

She did not write Thomas’s name.

The assignment did not need him.

At the bottom she drew the kitchen tree.

When Jennifer saw it, she cried.

Emily rolled her eyes.

“You cry at everything.”

“Not everything.”

“Yes.”

Jennifer laughed.

“Maybe.”

Emily put the paper in her school folder.

“Don’t bend it.”

“I won’t.”

“Promise?”

“Promise.”

Promises still mattered.

But they no longer all sounded dangerous.

At bedtime Jennifer reached for the doorknob.

Emily was already under the blanket.

“Open or closed?”

“Closed.”

Jennifer shut it.

Then Emily changed her mind.

“Wait.”

Jennifer opened it.

Emily thought.

“Halfway.”

Jennifer moved it halfway.

Emily smiled.

“I just like it like that tonight.”

Jennifer nodded.

No explanation required.

No symbolic milestone.

No test of bravery.

A door could be closed tomorrow and open tonight.

Healing did not need to prove itself in one direction.

Jennifer left.

Emily reached for Bunny.

His bent ear remained bent.

She no longer gripped it until her knuckles hurt.

She simply ran one finger along the fold.

Then she turned off the moon light.

Months earlier, she had needed a verdict to tell the world her father’s story was false.

Now the verdict still mattered.

But it was no longer something she had to think about every morning in order to feel safe.

That was a different kind of victory.

Quieter.

More durable.

And entirely hers.

Click here to continue reading: PART 33: When Emily Finally Asked What Happened to the 911 Recording, Claire Helped Her Understand Why One Frightened Call Could Outlive the Fear Behind It

The appeal began as expected.
